4QC Terms and Conditions
By placing an order with 4th Quarter Creations, LLC (“Company”), you (“Customer”) acknowledge that you have read, understood, and agreed to the following Terms and Conditions. These terms apply to all orders, services, and transactions.
Order Approval & Production

No order will enter production until full payment and written approval of artwork or proofs are received.

Written approval includes email confirmation, invoice approval, or digital proof acceptance.

Once approved, the order is considered final.

The Company is not responsible for errors in Customer-submitted or Customer-approved artwork, including spelling, grammar, dates, colors, sizing, or design layout.
Artwork Submission

Customer is responsible for providing print-ready files.
-
Screenshots, photos of notes, cropped images, or low-resolution files are not accepted.

The Company is not liable for poor print results caused by low-quality or improperly formatted files submitted by the Customer.
Print, Color, Cut & Size Tolerances

Industry-standard tolerances apply:

Color variations may occur due to printing processes and material limitations.

Cutting, folding, and sizing variances of up to 1/8 inch may occur.

Borders are discouraged due to trimming tolerances.
-
These variances do not qualify for refunds or reprints.
Garment Printing (Customer-Supplied Items)

Customers may supply their own garments for decoration. Customer-supplied garments are accepted at the Customer’s sole risk. 4th Quarter Creations, LLC assumes no liability for misprints, scorching, staining, shrinkage, fading, defects, or damage of any kind to Customer-supplied garments.

The Customer acknowledges that printing and decorating methods—including but not limited to DTF (Direct-to-Film), screen printing, and embroidery—require high heat, pressure, adhesives, and mechanical processes that may impact the integrity, appearance, or durability of the garment. Additionally, the Customer understands that equipment malfunction and human error are inherent risks in the production process.

If a Customer-supplied garment is damaged before, during, or after production, the Company will not replace the garment, reimburse its value, or issue any refund or reprint. Any damaged Customer-supplied item will be returned to the Customer upon request.

The Company strongly recommends purchasing garments directly through its approved suppliers to reduce production risk and ensure quality control.
Under no circumstances will refunds, credits, or reprints be issued for Customer-supplied garments that are damaged, defective, or unsuitable for decoration.
Turnaround Time

All turnaround times are estimates only and are not guaranteed.

Delays caused by suppliers, equipment, labor, weather, or other circumstances do not qualify for refunds or chargebacks.

Delays in estimated turnaround time are not eligible for refund, chargeback, or reprint.
Shipping

The Company is not responsible for delays, loss, or damage caused by third-party shipping carriers.

Responsibility transfers to the Customer once the order is released to the carrier or marked as delivered.
Cancellation
-
All orders placed with 4th Quarter Creations, LLC are final.
-
Once payment is received and an order has entered production, the order may not be canceled, modified, or terminated for any reason. By placing an order, the Customer acknowledges that the Company immediately incurs costs and renders services, including but not limited to design preparation, scheduling, materials allocation, and production labor.

The Customer agrees that full payment is earned upon production commencement, regardless of whether the Customer later refuses delivery, fails to collect the order, or requests cancellation.

The Customer expressly agrees not to initiate chargebacks, payment disputes, or payment reversals for services rendered under this agreement. The Customer further authorizes the Company to present these Terms & Conditions, order approvals, and payment records to any credit card company or financial institution as evidence that the transaction is valid and non-cancelable.

Failure to accept or collect the completed order does not relieve the Customer of payment obligations and does not entitle the Customer to any refund, credit, or reprint.
Refund Policy
In-Store Pickup Orders

Once the Customer receives the finished goods and leaves Company premises, the order is deemed accepted in full.

No refunds, exchanges, or reprints will be issued once products leave the property.
Shipped Orders
-
All orders are final. Refunds will not be issued for color variation, sizing tolerance, placement preferences, or production characteristics inherent to printing.
Transfer of Responsibility

The Customer assumes full responsibility for the order once picked up or marked as delivered. The Company is not liable for loss, damage, misuse, or dissatisfaction after that point.
Payment & Chargebacks

All orders must be paid in full before production.

The Customer agrees not to initiate chargebacks for services rendered and approved.

The Company reserves the right to dispute chargebacks using order approvals, invoices, and these Terms & Conditions.
Intellectual Property

The Customer warrants they own or have permission to use all submitted artwork and content.
-
The Customer agrees to indemnify and hold the Company harmless from any claims related to copyright or trademark infringement.
Indemnification
The Customer agrees to defend, indemnify, and hold harmless the Company from all claims, damages, costs, or legal fees arising from:

Customer-supplied content,

Unauthorized intellectual property use,

Violation of these Terms.
Limitation of Liability

All services and products are provided “As-Is” without warranties of any kind.

The Company shall not be liable for indirect, incidental, or consequential damages, including lost profits or event-related losses.
Governing Law & Dispute Resolution
-
These Terms are governed by the laws of the State of Michigan, USA.
-
Any disputes shall be resolved in Michigan jurisdiction.

Customer agrees to attempt written mediation prior to legal action.
Right to Subcontract
The Company may subcontract any portion of production or fulfillment as needed.
Promotional Use
Unless otherwise requested in writing prior to production, the Customer grants the Company permission to use completed work for marketing, samples, or portfolio purposes.
Changes to Terms
The Company may update these Terms at any time. Continued use of services constitutes acceptance of the current Terms.
